What Services Are Good For Outsourcing In Law Firms 2

Outsourcing research shows that only Repetitive Complex And Based
Processes (RP And B P) are best outsourced. Thus, in the legal context we
must identify repetitive complex and base processes. In litigation the
different stages are:
1. Pre-Filings - RC And B P include researching potential parties,
completing court forms and office forms, conducting simple
interviews, researching laws and cases for the lawyer to read,
communicating with experts and vendors and delivering third party
fees such as court fees.
2. The Pleadings - RC And B P include completing form or template

pleadings excluding tailored facts, responding to standard motions,
which require little executive thinking or innovation and amending
pleadings for technical errors.
3. Case Management - RC And B P include maintaining Abacus or a
similar calendaring system, to review court hearing dates from mailed
notices and online dockets, to enter case data, dates, to link
documents, to save as a note every oral or email communication, and
responding to standard communications, organizing hard and
computer folders, tracking billing and costs and complying with the
rules of procedure, electronic filing rules, and local rules.
4. Discovery - First, the LPO should conduct an interview with the
lawyer to commit all his or her executive functions about discovery to
writing and should ask for templates for requesting and responding to
discovery. After this critical executive function interview and after the
lawyer reviews and edits the notes of the interview, RC And B P
include preparing the Case Management statement in state courts,
preparing the initial disclosures and discovery plan in federal courts,
and requesting and responding to discovery.
5. Motions - First, the LPO should conduct an interview with the lawyer
to commit all his or her executive functions about motions to writing
and should ask for templates for writing and responding to motions.
After this critical executive function interview and after the lawyer
reviews and edits the notes of the interview, RC And B P include
preparing motions. Remember, many motions have established
judicial precedent, which requires minimum executive functions, thus,
can be outsourced.
6. Trial Preparation - Many firms source trial work to other lawyers in
the same jurisdiction thereby giving up all executive functions.
However, firms can retain trial executive functions but outsource trial
preparation. RC And B P functions suited for outsourcing include
coding of all exhibits and deposition transcripts, drafting trial briefs,
conducting detailed legal research, and reviewing all reports including
the expert report, conducting jury selection research and conducting
investigations.
7. Judgment Collections - Mostly all judgment collection activities do
not require executive functions. RC And B P functions include

obtaining entry of judgments, levies, tills, and debtor exams.
8. Appeals - The rule of established judicial precedent applies: issues on
appeal involving well-established judicial precedent are suited for
outsourcing and novel issues are not. For example, in criminal appeals
a defendant has the right to appeal even if it has no merit. A criminal
lawyer can outsource such appeals. Moreover, as to appeals, RC And
B P include drafting the notice of appeal, perfecting the record,
calendaring, drafting requests for extensions, obtaining others to write
amicus briefs, complying with appellate rules, conducting legal
research and preparing the lawyer for oral argument.
The above list is not an exhaustive review of all legal processes appropriate
for outsourcing. The lawyer must still comply with LPO Ethics.3
