NEBRASKA Part 58
Joint Physical Custody can be ordered only of a
judge decides it is the best interests of the children. Usually parents must be
able to get along with each other in order for joint physical custody to be
successful. More importantly, the
children must feel comfortable going back and forth between two different homes
on a frequent basis. If you and your spouse fought about how to raise the
children when you were together, you may have difficulty making joint physical
custody work. Child support could still be ordered if you and your spouse share
joint physical custody, as support is determined based upon each parent’s
income and the amount of time each parent spends with the children.
