NEVADA Part 12

Physical custody defines the person actually physically caring for the child.

Joint Legal Custody means the two parents work together to agree on religion, education and medical decisions.  Although if they cannot agree, for example, on cancer treatment, they can return to court and have the court decide based on the evidence they provide by either side.

Sole Legal Custody is not something that the court orders often, as the court sees it as stripping away a parent’s right to have input in the child’s upbringing.  It can usually only be found in severe domestic violence cases.

Primary Physical Custody is defined when one parent has the children at least 61% or more of the time.
