Joint Physical Custody is defined as the parents
sharing time with the children. The
timeshare between the parties must be a minimum of 60/40. While the parties may define joint physical
custody however they choose in a stipulation, the court will use the legal
definition if the matter is in front of it or it the matter returns to it for
modification. The court will count days,
not hours. The court will also not make
any differential between wake and sleeping hours, school and quality time, etc. Thus, if you are trying to establish that you
have joint custody, your goal is to show that the children are in your care at
least 142 days per year.
