STEP TWO - FILING YOUR DIVORCE CASE
The next step in your divorce is to file all the proper
paperwork with the court. You need to file a "Complaint" with the
court to start the divorce process. Your Complaint will tell the Judge:
When and where you
were married;
Where you live
now;
Where your spouse
lives now;
That you or your
spouse have lived in the state for the last year;
The names of your
children, the years they were born, and where they have lived the past five
years;
That you think the
marriage is over (irretrievably broken);
What you want to
happen with the children, your real estate, your furniture, your household
goods, and your bills
That you want or
do not want support (alimony) from your spouse;
That you want the
judge to end the marriage;
How you want the
judge to decide custody and visitation/parenting time
That you want the
judge to decide who pays what child support; and
Anything
else you want the judge to do. (e.g. wanting your former last name restored).
