My daughter is 12 and wants to live with me, can she tell the judge and will the judge listen to her?

Parental preference is a stated preference that a child can express, usually in the judge’s chambers without parents present or in a child interview.  A child interview can be conducted by the Family Mediation Center in Clark County to discuss the households, preference, or specific issues or by a licensed family or child therapist, psychologist or psychiatrist.  While the court will take into account what a child prefers, it becomes part of the best interest of the child analysis that the court performs in making a custody determination.  The child’s preference will not necessarily be the deciding factor.
