What happens if we have joint physical custody and I need to
relocate?
Parties cannot have joint custody and live in two
different states. (This may be different
if you live in Laughlin and the other parent lives in Bullhead City, Arizona,
for example.) As the parent who wants to
move, you will have to seek both a modification of custody to be the primary
custodian and a motion for relocation.
In response, the other parent may seek a modification of custody to be
the primary custodian. In seeking a
modification of custody, parties will have to address material change of
circumstances and the child’s welfare would be substantially enhanced by the
change.
