Will spousal abuse affect the designation of primary
residential parent?
Allegations of abuse are relevant and important, but
technically not controlling. If the abuse is shown to have affected the
children, the court will consider this along with the other factors discussed
above. Courts look at abuse allegations closely for obvious reasons. If a court
believes a spouse has made a false accusation of abuse to gain an advantage in
litigation, the consequences will be serious.
