When will child custody be decided?

Child custody can be decided amongst the parents through a voluntary agreement, which can be made into a family court order upon consent of the parties. Otherwise, absent agreement between the parents, child custody will be decided after a custody petition is filed in Family Court and a trial is held, or as part of a divorce action after a trial or hearing on custody is held.


However, prior to a final determination of custody at a trial, temporary orders of custody will be made until a trial is held at which point a permanent order will be made.
