Do I need to use a Guardian ad Litem/Custody Evaluator?
There is no requirement in New York that you must use a
Guardian ad Litem or Custody Evaluator. The closest thing in New York is the
attorney for the child, which the court will appoint to represent your child’s
wishes/position.
This attorney for the child will work with your attorney and
the other parent/parent’s attorney to either reach an agreement between the
parents or proceed to a trial.
