SOUTH CAROLINA Part 5

South Carolina grants both fault and no-fault divorces. If a spouse believes that the marriage should end on the grounds of adultery, alcoholism, physical abuse, or some other issue, then he or she can file for a fault divorce, and may stand to gain more. The no-fault divorce is based on irreconcilable differences, and the spouses must have lived apart for a year before they can file.
